Terms of Use for Advertisers

Advert:   The advertisement(s) content provided by the advertiser.
Advertiser:   The person, firm or company who contracts to advertise.
Agreement:   These terms and conditions and the advert booking details agreed upon.
Site:   The website on which Advert(s) will be displayed, bearing the domain name www.LocalBusinessWatch.com.
Services:   Any services provided under this Agreement.
LBW:   Local Business Watch.

LBW’s Responsibilities:

• LBW will display the Advert on the Site in its standard format applicable to the type of Advert chosen and paid for.
• LBW will use its reasonable endeavours to commence displaying the Advert within 72 hours of payment.
• LBW will use its reasonable endeavours to ensure that the Site is accessible.
• LBW makes no warranty as to the usage of the Site, which the parties recognise is beyond the control of LBW.
• Out of date Adverts whereby event dates have passed will automatically be removed in order to protect the integrity of the Site.
• LBW may refuse or remove any Adverts which it deems as unsuitable without warning or negotiation.
• While LBW will make every effort to ensure that the site is available at all times, LBW can not be held responsible in any way for consequenses arising from the site being unavailable for any reason, or for unforseen errors resulting in content not being displayed.

Advertiser’s Responsibilities

• LBW reserves the right to edit, amend or refuse to accept proposed Adverts which it considers to be offensive, unlawful or inappropriate, or which appear to infringe the intellectual property rights of any third party.
• The Advertiser warrants that all the facts, claims and offers given by it about its products or services are accurate and in no way misleading and that the terms of any offers contained therein will be honoured.
• The Advertiser will obtain all necessary licences or consents that may be needed in connection with the content or display of the Advert and the use of the artwork and other material supplied by it and it shall indemnify LBW in full against any costs, claims, demands or expenses which the LBW may incur as a result of breach by the Advertiser of this clause.

Limitation of Liability

• LBW shall not be responsible for any errors in any Advert.
• LBW shall not be liable under contract, tort (including negligence) or otherwise for any loss of production, loss or corruption of data, loss of profits or of contracts, loss of operation time, loss of goodwill and loss of anticipated savings, nor for any indirect or consequential loss, damage, cost or expense of any kind whatever and however caused.
• LBW shall be under no obligation to restrict or limit the type or number of advertisers which may advertise on the Site, and without limitation, the Advertiser shall have no recourse in the event that a competitive or conflicting business so advertises.
